The Social Security Disability Insurance (SSDI) benefits program can provide a steady source of income for disabled individuals who cannot work. An individual may qualify for disability if he or she is unable to perform any gainful work activity by reason of any medically determinable physical or mental condition which can be expected to result in death or which has lasted or is expected to last for a continuous period of not less than 12 months.
In addition, ERISA disability policies almost always require a disabled claimant to apply for SSDI benefits. Disability insurers are entitled under the policy language to take a credit for any SSDI benefits received.
